The main requirement for family unity parole in place is that only spouses and stepchildren of American citizens qualify. If you are one of them, you must meet the following criteria:
Requirements for spouses
- Residing in the United States without having gone through the legal admission processes or having obtained a temporary residence permit.
- Have continuously resided in the US from at least June 17, 2014 until the date of your application. That is, having been in the country for 10 years.
- Have entered into a legally valid marriage to a US citizen on or before June 17, 2024.
- Not have a disqualifying criminal record or be considered a threat to public, national or border security.
- Submit biometric data and undergo background checks and national security and public security reviews.
Requirements for stepchildren
- Have been under 21 years of age and be single as of June 17, 2024.
- Being in the United States without having been legally admitted or having received a temporary stay permit.
- Have continuously resided in the US from at least June 17, 2024 until the date of your application.
- Have an immigrant parent who married a U.S. citizen on or before June 17, 2024, and before you turned 18 years of age.
- Not have a criminal record or be considered a threat to public, national or border security.
- Submit biometric data and undergo criminal background checks.
In both cases, you must demonstrate that you deserve temporary stay permission (parole) for humanitarian reasons or significant public benefit.

What is the application process for Parole in Place for family unity?
To apply for temporary residence permit under the Parole in Place program for family unity, you must follow these steps:
1# File Form I-131F online
You must complete Form I-131F and pay the $580 filing fee. For this application, there are no fee waivers.
Each individual must complete and submit to USCIS a Form I-131F individually, including minors.
2# Complete the required fields and attach evidence
Be sure to fill out all required fields on the form and submit the necessary documentation, following the instructions detailed on the form.
3# Create an online account with USCIS
A parent or legal guardian can create an account with USCIS for a minor under 14 years of age and complete the form on their behalf.
If this is the case, the parent or guardian should include their own information in the “preparer” section of the form.
What happens after I apply for Family Unity Parole in Place?
After filing Form I-131F you will need to provide your biometric data. USCIS will evaluate your application to determine if you meet the requirements and can be granted parole in place.
- If granted : This permit lasts for 3 years, but is subject to cancellation at any time. You may also apply for an Employment Authorization Document (EAD) using Form I-765.
- If you are denied: Normally a notice to appear will not be issued nor will your case be referred to ICE.
If you are granted this permission, you may have the opportunity to apply for a Social Security Number (SSN). To do this, follow the instructions on form I-765.
Can I travel outside the United States with Parole in Place for Family Unity?
Under the “Keeping Families Together” program, international travel is not permitted. In fact, if you leave the country, your parole in place will be automatically cancelled.
Furthermore, when you leave the United States, you run the risk of not being able to return and may lose eligibility for future immigration procedures.
Can I get a Green Card after Family Unity Parole in Place is approved?
No, Parole in Place for family unity does not guarantee obtaining a Green Card. To apply, you will need to file an immigrant application, such as a petition by means of US family-based immigration . USCIS will evaluate your eligibility for these applications separately.
